A 2025 Supreme Court case addressed Internet providers and unauthorized gambling sites. Chile's casino law, participant provisions and still-pending online-betting bill answer different questions.

What the dates mean

These records do not establish a general online-poker authorization or a personal exemption. Chilean rules distinguish operating a gambling service, visiting a gambling house, a particular licensed activity and the facts of any one game. Get current qualified Chilean advice before relying on a legal or tax conclusion about your own circumstances.

What the Supreme Court actually ordered

The publicly hosted copy of the judgment has not been independently authenticated through the judiciary portal. It records that on 29 September 2025, the Third Chamber of Chile's Supreme Court decided Rol 18.080-2025 by a 3–2 majority. Lotería de Concepción brought a constitutional recurso de protección against Claro Chile, Entel, GTD Manquehue, Telefónica Chile, WOM and VTR after they had not blocked online betting sites it identified. The court reversed the earlier rejection of the action.

The judgment's operative paragraph directs those six Internet providers to block immediately the sites Lotería requested in those proceedings, unless legal and administrative authorization is shown. Its reasoning treats unauthorized online gambling offerings as unlawful and the providers' refusal as harming Lotería's constitutional property right. It cites the Civil and Penal Codes and discusses the narrow legal authorizations for Lotería, Polla Chilena and other specified activities.

This was a protection case about the providers' conduct. The operative text does not list five brands, require DNS or IP blocking, or give a universal technical order for every site on the Internet. It does not convict a poker player or decide whether a particular poker product is legally authorized. The court did cite participant as well as operator provisions, so the case cannot support an inference that players are categorically outside Chilean law.

Boletín 14.838-03 is still a bill

The Senate approved Boletín 14.838-03 in general in August 2025 during its second constitutional stage. A June 2026 Senate account said amendments still required votes. On 8 September 2026 the Senate continued to describe committee work on a proposed text, including unresolved licence and tax terms. This review could not directly open the live Cámara docket, so it does not claim a later formal docket event.

Approval in general is a step in parliamentary consideration, not an enacted licence. Proposed taxes, fees, regulator powers and covered products can change during amendment and final votes. No enactment date or applicant's eventual approval follows from the docket. The existing court and statute records above remain the relevant starting points while the proposal is pending.

Enforcement and tax records answer separate questions

The Supreme Court case resulted in a site-blocking order against six Internet providers, not a criminal judgment against users. SCJ says it refers complaints about unauthorized online gambling to prosecutors because its own supervisory remit covers authorized casinos. Those records do not provide a complete count of criminal cases or establish that participants are immune. Article 278 remains a separate provision; its application needs the specific facts.

In June 2026 the tax authority, SII, created a digital VAT compliance route for nonresident online-betting service providers. SII expressly said this tax measure does not decide authorization, sector supervision or legality. Its FAQ on international casino winnings addresses a particular income-tax question for Chilean residents; it does not supply a universal poker filing method or turn an unauthorized service into an authorized one.

A few verified pieces of Chilean poker history

Organizer records confirm that Chile has hosted notable land-based tournaments. PokerStars reported Oscar Alache's 2015 Latin American Poker Tour Main Event win at Enjoy Viña del Mar, and its 2016 coverage places another LAPT Chile Main Event at Viña del Mar. These are dated event accounts, not a current casino or poker-room register.

At an international event, WSOP recorded Chile's Nicolás Fierro in fourth place in its 2013 $1,500 No-Limit Hold'em Event 40, for $165,501. That single result is more reliable than an unmaintained lifetime ranking and says nothing about present online-play permission in Chile.

Frequently Asked Questions

Is online real-money poker authorized in Chile?

The records checked here do not identify a general Chilean authorization for an online real-money poker service. Law 19.995 expressly excludes online games of chance from land-casino operating permits, while the regulator says gambling operations need specific legal authorization. Some lottery, sports-prediction and horse-racing activities have their own narrower legal channels. Whether particular poker conduct meets a legal definition or exception needs current Chilean advice; a pending bill does not create permission.

What did the Supreme Court decide in September 2025?

In Rol 18.080-2025, the Supreme Court's Third Chamber granted Lotería de Concepción's protection action against six named Internet providers. On 29 September 2025 it ordered those providers to block immediately the sites requested by Lotería in that case unless legal and administrative authorization was shown. The judgment concerns Internet providers and unauthorized gambling offerings; it is not an individual online-poker prosecution or a licensing decision for any poker product.

Did the court order every gambling site blocked by a specified technology?

The operative paragraph says the six respondent providers must block all sites requested by Lotería de Concepción in those proceedings. It does not enumerate five brands or prescribe DNS or IP blocking. A claim about later mirror domains would require a separately checked order; the September judgment alone does not establish it.

Does Chilean law address people who play, as well as operators?

Yes, the Supreme Court cited both Penal Code Article 277, about operators of gambling houses, and Article 278, about people who go to play at the houses referred to in Article 277. Article 278 provides imprisonment or a fine. The September protection case did not decide whether those elements are met by any particular remote poker activity, and a missing published case is not immunity.

Has Boletín 14.838-03 legalized online poker?

No. The Senate recorded its approval in general during the second constitutional stage in August 2025, but a general vote is not enactment. Its June 2026 account said amendments still required votes; its 8 September 2026 report still described committee work on the bill. The records checked on 27 September do not establish enacted licensing. Proposed terms can change before any law takes effect.

Does the 2026 online-betting tax rule make a platform legal?

No. The SII's June 2026 measure addresses registration and digital VAT obligations of nonresident online-betting service providers. The tax authority expressly says the measure does not decide sector authorization or legality. It also is not a complete guide to an individual player's tax return.

Can an authorized land casino offer online poker under its casino permit?

Law 19.995 Article 5 says the operating permit for a casino does not include online games of chance. A land venue's permission and any approved game catalogue do not by themselves authorize a remote poker service. Check a specific venue or event with the SCJ and its current records.

What does Chile's tournament history establish?

PokerStars reported that Oscar Alache won the 2015 LAPT Main Event at Enjoy Viña del Mar and covered another LAPT Chile event there in 2016. WSOP recorded Nicolás Fierro finishing fourth in a 2013 Las Vegas event. These are historical organizer results, not proof that a Chilean poker room is currently approved or that online play is permitted.

What changed in this review

An earlier version called the casino statute silent on online games, described the court remedy as a prescribed DNS/IP block of five named brands, treated an unverified later mirror-site account as an order, and suggested enforcement reached operators but not players. The statute, judgment's operative text and Penal Code require the narrower descriptions above.
